This
seminar is designed to explore issues relating to the preparation
of appraisal analysis that will be reviewed/relied upon by government/public
entities. The learning objectives for this seminar are:
•Duties of good faith and fairness on behalf of the Crown or
other public entities. •Dynamics of negotiation by and with public
entities and understanding the nuances of negotiation when the final
say is from elected person or group, being advised by staff.
•Requirements of transparency in government dealings - this transparency
is important throughout all stages of dealings with government.
•Public accountability by government and the impacts this has
on consultants working for government.
•Considerations relating to Privacy/Freedom of Information legislation.
The Changes to the Rules of Civil Procedure and the Duty of an Expert
The focus of this presentation will be on the amendments to the Rules
of Civil Procedure that come into force on January 1, 2010 and relate
to expert reports and expert evidence. It is important to understand
the Rules of Civil Procedure which govern expert reports in the course
of litigation, whether these reports are in court being used simply
for negotiations in order to avoid court.
An
example of the new Rules regarding expert reports:
DUTY OF EXPERT 4.1.01
(1) It is the duty of every expert engaged by or on behalf of a party
to provide evidence in relation to a proceeding under these rules,
(a) to provide opinion evidence that is fair, objective and non-partisan
(b) to provide opinion evidence that is related only to matters that
are within the expert's area of expertise; and
(c) to provide such additional assistance as the court may reasonably
require to determine a matter in issue.
DUTY PREVAILS
(1) prevails over any obligation owed by the expert to the party by
whom or on whose behalf he or she is engaged.
(2) The duty in sub-rule The presentation will also discuss the substantial
changes to the discovery process that are contemplated under the new
Rules. The Rules are attempting to streamline this process, make it
proportional to the claim and shorten it however possible. The presentation
will also touch on other amendments that may relate to trials in which
appraisers are involved. |
